1. Invite-Only Access

Access to this site and the Fathomless Beta is by invitation only. You may not share your login credentials or “Invite Keys” with any third party.

2. “As-Is” Beta Software Warning

IMPORTANT: THE GAME IS IN A BETA TESTING PHASE.

The Game is provided “AS IS” and “AS AVAILABLE” without any warranties of any kind. You acknowledge that the Game may contain bugs, errors, and may cause system instability or data loss. Simon de la Salle – Web Consultant is not liable for any damage to your hardware or loss of data resulting from your participation.

3. Intellectual Property

All content on this website and within the Game “Fathomless” (including text, graphics, logos, and code) is the property of Simon de la Salle – Web Consultant and is protected by copyright laws.

4. Feedback License

By submitting feedback, bug reports, or suggestions, you grant Simon de la Salle – Web Consultant a perpetual, irrevocable, royalty-free license to use and implement those ideas in the Game without compensation to you.

5. Termination

We reserve the right to terminate your access to the Beta and this website at any time, for any reason, without notice.

6. Governing Law

These terms shall be governed by and construed in accordance with the laws of the jurisdiction in which the Company is registered.

This Privacy Policy describes how Simon de la Salle – Web Consultant (“we,” “us,” or “the Company”) collects and handles information for the Fathomless (“the Game”) Beta Program via our invite-only website, https://fathomlessgame.com/.

1. Data Collection & “No Tracking” Commitment

We value your privacy. Unlike many websites, the Fathomless website does not use cookies, tracking pixels, or third-party analytics (such as Google Analytics) to monitor your browsing behavior.

We only collect information that you explicitly provide to us to facilitate the Beta test:

• Account Data: Your email address and name provided during the “Invite Only” registration process.
• Feedback & Bug Reports: Any information you voluntarily submit via email or feedback forms regarding your experience with the Game.
• Game Data: As part of the Beta testing process, the Game client itself may collect technical logs (e.g., crash reports, hardware specifications, and gameplay telemetry) to help us identify and fix bugs before the official release.

2. How We Use Your Information

Your data is used strictly for the following purposes:

• To grant you access to the private Beta environment.
• To communicate with you regarding updates, bug fixes, and Beta-related announcements.
• To improve the Game based on your technical feedback and bug reports.

3. Data Sharing

We do not sell, rent, or trade your personal information. Your data stays within the “Fathomless” project and its parent entity, Simon de la Salle – Web Consultant. We may only share data with third-party service providers (such as our server hosting or email delivery providers) solely for the purpose of operating the Beta program under strict confidentiality.

4. Confidentiality and NDA

By accessing this invite-only website and the Fathomless Beta, you acknowledge that the Game is currently in a pre-release state. Your participation is subject to the Non-Disclosure Agreement (NDA) agreed upon during your sign-up. You agree to keep all game mechanics, visuals, and technical issues confidential.

5. Data Retention

We will retain your information for the duration of the Fathomless Beta Program. Once the Beta concludes, we will securely delete your personal data unless you choose to opt-in to our mailing list for the Game’s official launch.

6. Your Rights

You may contact us at any time to:

• Request a copy of the data we have on file for you.
• Request that we delete your account and data (which will end your participation in the Beta).
• Correct any inaccurate personal information.

This Agreement is between Simon de la Salle – Web Consultant (“Discloser”) and you, the Beta Tester (“Recipient”).

1. Confidential Information

Confidential Information includes all information related to the game “Fathomless” disclosed during the Beta period, including but not limited to: gameplay mechanics, storylines, artwork, sound effects, source code, bug reports, performance metrics, and screenshots or video recordings of the Game.

2. Non-Disclosure Obligations

The Recipient agrees to:

• Keep all Confidential Information strictly confidential.
• NOT record, stream, or broadcast gameplay (e.g., via Twitch, YouTube, or Discord) unless explicitly authorized in writing.
• NOT share screenshots or descriptions of the game on social media or public forums.
• Use the Game solely for the purpose of testing and providing feedback to the Discloser.

3. Ownership

All Confidential Information remains the sole property of Simon de la Salle – Web Consultant. No license or rights are granted to the Recipient except for the limited right to test the Game.

4. Term

This Agreement remains in effect until the Game is officially released to the public by the Discloser, or until the Discloser provides written notice that the information is no longer confidential.

Penalty for Breach: Unauthorized disclosure of Confidential Information may result in immediate termination of Beta access and may subject the Recipient to legal action for damages.
